Many people who have never read the works of Nietzsche possess some vague notion of what he taught. For them the philosophy of Nietzsche is represented by a few floating ideas—“Superman,” “Will to Power,” and even perhaps “blond beast.” Others again have learnt a little more about Nietzsche and perhaps read something of what he actually said; yet the net result is an impression of a passionate and destructive thinker, who launched his attacks on this side and on that, without (...) any regard for consistency. For them there can be no philosophy of Nietzsche: they know that he often wrote in the form of aphorism and they picture his thought in general as a series of detached utterances, many of which are mutually exclusive. It may then be of use to some, if we attempt to set forth the guiding inspiration and leading ideas of Nietzsche, for when these have been grasped, it will be seen that it is by no means absurd to speak of a philosophy of Nietzsche. It may well be impossible to reconcile all his utterances, at least so far as the words are concerned—though Nietzsche is of course not the only philosopher who betrays inconsistency in his thought—but it should be remembered that Nietzsche was not given to standing still: his thought developed. Moreover, he often spoke in an exaggerated form, so that some of the apparent inconsistencies may be ascribed to over-emphasis. In any case, even granting the presence of irreconcilable inconsistencies in his thought, Nietzsche's various theories not only may, but must, be seen as a whole, if they are seen in the light of his guiding ideas and inspiration. This paper examines whether the modern bioethical principles of respect for autonomy, beneficence, non-maleficence, and justice proposed by Beauchamp and Childress are existent in, compatible with, or acceptable to the leading Chinese moral philosophy—the ethics of Confucius. The author concludes that the moral values which the four prima facie principles uphold are expressly identifiable in Confucius’ teachings. However, Confucius’ emphasis on the filial piety, family values, the “love of gradation”, altruism of people, and the “role specified relation oriented ethics” will (...) inevitably influence the “specification” and application of these bioethical principles and hence tend to grant “beneficence” a favourable position that diminishes the respect for individual rights and autonomy. In contrast, the centrality of respect for autonomy and its stance of “first among equals” are more and more stressed in Western liberal viewpoints. Nevertheless, if the Confucian “doctrine of Mean” and a balanced “two dimensional personhood” approach are properly employed, this will require both theorists and clinicians, who are facing medical ethical dilemmas, of searching to attain due mean out of competing moral principles thus preventing “giving beneficence a priority” or “asserting autonomy must triumph”. We conclude by arguing that many of the current problems could be avoided by returning PIAG’s responsibilities to research ethics committees, and by allowing “opt-out” consent for many public health research projects. In a recent case in the UK, six men stored their sperm before undergoing chemotherapy treatment for cancer in case they proved to be infertile after the treatment. The sperm was not properly stored and as a result was inadvertently destroyed. The men sued the NHS Trust that stored the sperm and were in the end successful. This paper questions the basis on which the judgement was made and the rationale behind it, namely that the men ‘had ownership’ of the (...) sperm, and that compensation was thus due on the grounds that the men’s property had been destroyed. We first argue that the claim is erroneous and enhances the tendency towards the commodification of body parts. We then suggest that the men could have been compensated for the harm done to them without granting property rights, and that this would, at least in philosophical and ethical terms, have been more appropriate. To help illustrate this, we draw on a parallel case in French law in which a couple whose embryos had been destroyed were overtly denied ownership rights in them. Finally, we suggest some possible ethical and practical problems if the proprietary view expressed in the UK ruling were to become dominant in law, with particular focus on the storing of genetic information in biobanks. We conclude that, although compensation claims should not necessarily be ruled out, a ‘no property in the body’ approach should be the default position in cases of detached bodily materials, the alternative being significantly ethically problematic. The most he affirms is that ‘there is nothing to choose between the two eclipses astronomically’; and what he asks for is a new examination of ‘the literary evidence without that unconscious bias in favour of the 648 B.C. eclipse which so far has influenced it’. In this paper I want to do the following things. First I want to show that in the part of the Theaetetus where the relationship between knowledge and perception is examined, the concept of knowledge that is in question is very clearly characterized. We are left in no doubt as to what is to count as knowing. Secondly I want to unravel in some detail the case that Socrates puts on Protagoras’ behalf where he draws on what Protagoras actually wrote (...) (151 E-152C); as opposed to what he may have taught secretly to his pupils (152C-160D). Thirdly I wish to argue that if we let the dialogue speak for itself, it is manifest that this case put up on Protagoras’ behalf at 151 E-152C is not overthrown; it is not even shaken. (shrink)

No. 20 in the Marquette series "Mediaecal [[sic]] Philosophical Texts in Translation," this translation is based on J. R. O’Donnell’s edition of the only extant manuscript of the Universal Treatise, and is preceded by a helpful introduction of 28 pp. plus a selected bibliography. An English version of this work should be welcomed by scholars not versed in Latin who are nonetheless interested in Nicholas’ thought, whether because of his highly critical reactions to Aristotle and Averroes or because of certain (...) similarities between his philosophical views and those of Hume. If the latter are primarily to be found in his two extant letters to Bernard of Arezzo, the former constitute the very heart of this work. It should also be noted that the Universal Treatise was originally intended to recall university professors, especially at Paris, to the study of Christianity and ethics. Written c. 1340, its attacks on Aristotle and Averroes were intended to contribute to this purpose. Nevertheless, some of the positions expressed therein were to bring Nicholas himself into conflict with ecclesiastical authority. Not least among these troublesome views from the standpoint of religious orthodoxy was the suggestion that all things are eternal. The situation was further complicated by Nicholas’ contention that not all the views found in the Treatise represent his own convictions. Many are to be taken as probable or more probable. In his attacks on Aristotle and Averroes he does not claim to disprove demonstratively what they held, but only to show that their opinions are less probable than those he advances. Granted that the chief unifying factor in this work is negative, its anti-Aristotelian and anti-Averroistic thrust, yet, as is suggested in the introduction, some kind of positive unifying theme is also at work, Nicholas’ view of the good. Since the universe must always contain the same amount of goodness, everything in it must remain in existence. Therefore the universe consists of unchangeable atoms. From this atomism follows the view that space consists of points and time of instants. Since change in quantity and place cannot produce or destroy real being, Nicholas must therefore hold that quantity is really identical with material substance and that movement is nothing but change in the position of atoms. Moreover, if things are eternal, it is probable that the same holds for the actions of the soul. As eternal such acts remain unchanged and hence do not vary in degree of intensity. They simply pass from person to person. Consequently, the same object cannot be seen clearly and obscurely. Nicholas also suggests that all things are as they appear, granted that such must be accepted not because it has been proved but because this conviction gives pleasure to the mind. Again, he argues that since a cause can produce only one kind of effect, not all things have been produced by God whether as their total or as their partial cause. He then suggests that because God’s power is infinite, no effect can be produced by him naturally. As finite such an effect would not be proportioned to his infinite power. His arguments against any kind of Averroistic theory of one separate intellect for all mankind are both interesting and unusual. In fact he appears to go to the opposite extreme, not only defending individual intellects for individual men but also suggesting that in one and the same soul there are as many intellects as concepts. That Nicholas himself saw some difficulties with this position may be inferred from his admonition that further thought be given to this matter. If the same might be said of other unusual theories advanced in the Treatise, its translators are to be commended for having made it available to English language readers.—J. F. W. (shrink)

Harry (bio)Scientists overwhelmingly agree that climate change is anthropogenic, caused by our greenhouse gas emissions.1 Given the evidence that exists, we should be able to convince ourselves to change the everyday behaviors resulting in these emissions. If we hope to save ourselves, other animals, plants, and the environment from a devastating future, then why would we continue to use fossil fuels?The answer here is (...) not an easy one. And yet, the ancient Greek philosopher, Aristotle, provides us with a possible cause. In his most famous work on ethics,2 Aristotle argued that being weak-willed, suffering from what he called, “akrasia,” is the reason we do things that we know we shouldn’t do. It is a condition that results when desire wins over reason. For example, I eat a chocolate bar when I know I should eat a salad because my desire for chocolate wins over what I have reasoned to be best for my health. Simply put, reason might be what distinguishes us from other animals and plants, but it is not always our most powerful faculty. It stands both to experience and to reason, then, that rational decision might not be what is going to get us out of this climate crisis. Then, what is?In this special issue, we hear from five contemporary scholars of the 18th–19th century German philosopher, F.W.J. Schelling, an oft-called “protean thinker” whose prolific, sometimes creative, and diverse works spanned over seventy years. A onetime roommate of Hegel and Hölderlin, Schelling’s works are lesser-known outside specialist circles, and yet one finds that his prescient insights continue to have much to offer. This is especially true vis-à-vis the climate crisis, as Schelling was the first post-Kantian philosopher to take nature seriously. He eschewed the modern, Kantian, and post-Kantian trend to focus on [End Page 1] ipseity, the self, and on what we as humans can rationally know. Instead, he returned to metaphysics and argued for a wholistic conception and experience of life—all life. For Schelling, humans are rational as an expression of nature, rather than as an exception to nature. As John Sallis put it so well as he argued for the Platonic influence in Schelling: “For what Schelling rewrites within the text of modern philosophy is a discourse on nature.”3 Sallis then reminds us that in Schelling’s 1809 text, Philosophical Investigations of the Essence of Human Freedom (“Die Freiheitschrift”), he openly criticizes post-Cartesian philosophy generally for its exclusion of nature; “All modern European philosophy since it began with Descartes has this common defect, that nature does not exist for it and that it lacks a living ground.”4 Schelling’s intention was to resolve the defect, and because of his efforts in this regard, his work has something to say to us about our relationship to the environment.The idea to think about what Schelling can offer us in our current climate crisis is hardly new. In 2014, the North American Schelling Society (NASS), hosted by Bruce Matthews and Bard College, thematized its third international conference on “Schelling in the Anthropocene,” asking scholars to think beyond modern philosophy’s legacy of the human/nature divide and to discuss Schelling’s contribution to the anthropogenic environmental crisis we currently face. Since then, published work on this topic includes: Bruce Matthews’s, “Schelling in the Anthropocene,”5 Christopher Lauer’s, “Confronting the Anthropocene,” 6 and Vincent Lee’s, “Schelling and the Sixth Extinction.”7 Other journals have published special issues on related topics, including McGrath et al. We will show that there is a strong form of emergence in cell biology. Beginning with C.D. Broad's classic discussion of emergence, we distinguish two conditions sufficient for emergence. Emergence in biology must be compatible with the thought that all explanations of systemic properties are mechanistic explanations and with their sufficiency. Explanations of systemic properties are always in terms of the properties of the parts within the system. Nonetheless, systemic properties can still be emergent. If the properties of the components (...) within the system cannot be predicted, even in principle, from the behavior of the system's parts within simpler wholes then there also will be systemic properties which cannot be predicted, even in principle, on basis of the behavior of these parts. We show in an explicit case study drawn from molecular cell physiology that biochemical networks display this kind of emergence, even though they deploy only mechanistic explanations. This illustrates emergence and its place in nature. (shrink)
